
These terms and conditions shall apply to ALL CONTRACTS between Cheshire Interiors
and the Customer and no variation of these terms and conditions shall be effective
unless agreed in writing and signed by a duly authorised representative of the
company.
1. Definition
In these terms and conditions and in all Contracts to which these terms and
conditions apply:
- “the client” shall mean yourselves
- “the company” shall mean Cheshire Interiors
- “the materials” shall mean chipboard, melamine and MDF
- “the goods” shall mean the furniture specified in the drawing
2. Termination
The Goods ordered under this Agreement are purpose made specifically for the
customers particular requirements and accordingly the customer has no right to
terminate the Agreement.
3. Terms of Payment
A deposit of 25% is required on
acceptance of the order/quotation followed by 65% on delivery of goods and the
outstanding 10% on day of completion.
- The price of this order/quotation is valid for product fitted within 30 days
of the quotation date after which it may be subject to review.
- Cheques should be made payable to Cheshire Interiors.
- Upon the signing by the Purchaser and a duly authorised representative of
the company of the form of acceptance overleaf a binding contract will be created
in respect of the order details of which are given overleaf and such contract
shall not be subject to cancellation by the Purchaser although the Company reserves
the right to cancel any order refunding all monies paid upon receipt of an unsatisfactory
survey report from its surveyor. Without prejudice to its right to claim
damages for breach of contract the Company may at its sole description in appropriate
cases agree to the cancellation of an order by the Purchaser upon the payment
to the Company of all expenses incurred by it prior to the date of cancellation.
- The Customers deposit is not returnable if the order is cancelled after Cheshire
Interiors have ordered any item specifically relating to the customer order,
or we have incurred some cost in preparing the order.
- The Purchaser shall not be entitled to withhold payment by reason on any
alleged minor defect. The Company will investigate any alleged defect
after payment in full of the balance payable on completion. When payment
is not made on the due date in accordance with this condition, the Company shall
have the right to require payment of interest on the outstanding amount at a
rate of 2% per month from the due date until the date of actual payment.
4. Completion
- The Company will ensure that they shall complete the installation of
the Goods within a reasonable time. It is an expressed condition however
that time shall not be of the essence in respect of the Completion of the installation
of the Goods by the Company.
The Client agrees to give free access to the Company installers to carry
out installation of the Goods and shall ensure that such necessary re-routing
of electrical and plumbing installations are carried out at the clients own cost
in order that the Company can proceed to install the Goods.
5. Title to the Goods
Unless otherwise agreed in writing all materials delivered to the customers
premises in connection with the work shall be at the customers risk after delivery,
but that ownership of such materials shall not pass to the customer until payment
is full of the price payable to the Company for the work.
6. Damage
The Company will ensure that all necessary action is taken to avoid damage
to the Goods when installing the same and shall ensure that the installation
is fitted in accordance with the specification outlined in the drawing. The
Company will not however be responsible for any non-alignment of the installation
by reason of the installation being fitted on carpet at the client’s request.
7. Materials
- In the event that any installation requires a panel to be greater in length
than 96 inches the Company reserves the right to make a joint in the panel making
good the same and in such circumstances the Client shall raise no complaint thereon.
- Only items what are included on the contract will be supplied. Customers
should not assume items such as shelves, mirrors, etc, will be supplied unless
they are included in the contract.
8. Regulations
The client shall be responsible for ensuring that the Installation of the
goods comply with fire regulations and that all necessary Consents from the Parties
are obtained.
9. Alterations
- If the customer wishes to make any alterations or additions to the design
or specifications, the customer must inform the Company in writing at least 7
days before the due fitting date. The costs of any alterations or additions
out of this time scale will have to be borne in full by the customer.
- All telephone communications in connection with this order must be confirmed
in writing within 7 days of the telephone call.
10. Guarantee
Workmanship is covered by a fully comprehensive FIVE YEAR GURANTEE.
11. Miscellaneous
- If any additional work/faults to electrics, gas, plumbing, plastering or
building and joinery work are found that could not have been anticipated after
work has commenced, then a further quotation to correct the faults will be provided
- If the customer requires Cheshire Interiors to remove/dispose of fridges
or freezers there will be a charge of £150.00 for the removal/disposal
of these items.
